HB 2269 increases the penalty for a person who willfully flees or attempts to elude a pursuing law enforcement vehicle from a Class 5 felony (1.5 years prison/$150,000 fine) to a Class 3 felony (3.5 years prison/$150,000 fine).
Currently, a driver of a motor vehicle who willfully flees or attempts to elude a pursuing law enforcement vehicle is guilty of a Class 5 felony. Statute requires that the law enforcement vehicle must be marked to show that it is a law enforcement vehicle. The law enforcement vehicle must be operated with an audible sound such as a bell, siren or exhaust whistle and be equipped with a red or red and blue light that is visible under normal atmospheric conditions.
· Increases the penalty for a person who willfully flees or attempts to elude a pursuing law enforcement vehicle from a Class 5 felony to a Class 3 felony.
