HB 2266 changes municipal zoning law by requiring that one additional landowner file a protest in conjunction with a person who owns 20 percent or more of the area included in the proposed change in order to trigger the three-fourths vote requirement.

HB 2266 failed to pass the Counties & Municipalities Committee.

History

In order to protest a proposed zoning change, current statute (A.R.S. § 9-462.04) requires the owners of 20 percent or more of the lots included in the area of the proposed change or in the area immediately adjacent to that area must file a written protest with the governing body of the municipality.  Upon this filing, the proposed change is not effective unless three-fourths of all the members of the governing body approve the proposed change.

Provisions

·              Requires a protest to be filed by one additional landowner in an area where a protest is allowed if the sole other protester owns 20 percent or more of the land in the area of the proposed change in order to trigger the three-fourths vote requirement.
