HB 2260 extends the restriction that liquor licenses shall not be issued for premises within 300 horizontal feet of schools or churches to include child care centers and preschools.

History

Current law restricts the issuance of a liquor license for a premise located within 300 hundred horizontal feet of a public or private school, church or recreational area adjacent to a school. The law does make allowances for restaurants, special events, hotel-motels, government, and fenced playing areas of golf courses issued pursuant to statute. The Licensing Division of the Arizona Department of Liquor Licenses and Control is the entity that issues, transfers and renews all licenses. The Investigations Division is responsible to ensure that all licensees statewide adhere to the licensing laws (A.R.S. Title 4). HB 2260 extends the current law to prohibit the issuance of liquor licenses within 300 hundred horizontal feet of a child care center or preschool.

Provisions

· Prohibits the issuance of a liquor license for any premises located within 300 horizontal feet of a child care center or preschool.

· Allows the renewal of a valid license if on the date of the original application the premises were not within 300 horizontal feet of a child care or preschool.

· Authorizes the transfer of a validly issued license, which on the date of application for transfer is located within 300 horizontal feet of a child care center or preschool.

· Permits a spirituous liquor license of the same class to be issued for premises which have a nontransferable valid license on the date of application which are within 300 horizontal feet of a child care center or preschool.

· Stipulates a liquor license may be issued for premises that have a valid beer and wine store license which are located within 300 horizontal feet of a child care center or preschool.
