HB 2246 removes the ability for a county board of supervisors to vote on the formation of a public health services district.
Laws 2000, chapter 11 eliminated the option for a county board of supervisors to establish a city, city-county or multi-county department of health. In lieu of these options, the bill required a county board of supervisors to either establish a county department of health or a public health services district.
A public health services district may be formed by a majority vote of the public or through a unanimous vote by a county board of supervisors. The Board of Directors of a public health services district may levy a transaction privilege tax on businesses within the district or secondary property tax by resolution to fund the district. The cost for financing any building is not counted against expenditure restrictions.
According to the County Supervisors Association of Arizona, no counties have created a public health service district since the legislation passed in 2000.
