HB 2229 allows manufactured home buyers to maintain security by withholding up to ten percent of the cost of the manufactured home until its satisfactory completion.

History

The office of administration within the department of building and fire safety (B.A.F.S.) oversees the offices of manufactured housing and the state fire marshal. The office of administration ensures that the offices of manufactured housing and the state fire marshal follow all rules and laws pertaining to them. The director of the department appoints an assistant director of the office of administration to help carry out the duties of the department.

 

Provisions

·          Requires B.A.F.S. to set a rule requiring contracts for the purchase of manufactured homes to allow the withholding of up to ten percent of the cost of a manufactured home until its satisfactory completion.

 

·          States that the rule shall further require the manufactured home buyer to pay the withheld amount at the time the buyer submits a written statement of the manufactured home’s satisfactory completion.

 

·          Broadens agency disciplinary actions to any licensed manufacturer, dealer, broker, salesperson or installer who fail to use a contract that allows manufactured home buyers to withhold up to ten-percent of the total purchase price of a manufactured home for security of its satisfactory completion.
