HB 2223 gives the Director of the Department of Public Safety (DPS) the responsibility to delegate the security assistance for state buildings and property.
Currently, the Supreme Court and Legislative Council may obtain security assistance from DOA. In addition, the DOA is responsible for the security of the state capitol executive tower, all buildings owned or leased by the state and located near the state capitol building, the state office buildings in Tucson, and the buildings maintained by the Department of Transportation, the Arizona Power Authority, and the State compensation fund. The department is also responsible for the policing of state property and issuing citations in response to violations at these locations. An Administrative Law Judge hears cases involving citations issued by the Department of Administration on state grounds.
· Repeals the requirement for DOA to police and secure state buildings and gives this responsibility to the Director of DPS to delegate.
· Eliminates the ability of the Supreme Court and Legislative Council to obtain security assistance from the DOA.
· Maintains that the Administrative Law Judge is responsible for conducting hearings regarding citations received from DPS on state property.
· Allows the Director of DPS to employ officers and other personnel as deemed necessary for the protection and security of state buildings, including state buildings in Tucson, the grounds in the Governmental Mall area and persons who are on any of those properties.
· Allows employees of DPS to make arrests and issue citations for criminal or traffic offenses and violations of rules adopted for the control of vehicles on state property.
· Makes numerous technical and conforming changes.
