HB 2217 requires a physician before performing an abortion to inform the woman that the procedure will subject the child to fetal pain and offer the option of anesthetizing the child to the extent possible. 

 

Provisions

·          Requires a physician to inform the woman prior to an abortion that the child will be subject to fetal pain and ask the woman if she wishes the child to be anesthetized.

·          Stipulates the woman must certify in writing prior to the abortion that the physician provided her the information.

·          States that the license of the physician is subject to suspension or revocation if the physician violates this section.

·          Prescribes a Class 3 misdemeanor [30 days/$500] to a physician who fails to provide the required information.

·          Defines abortion.
