HB 2139 requires the Board of Optometry (Board) to provide access to the investigative file to a current or former licensee who was disciplined.
The Board examines and licenses approximately six hundred professional optometrists. The Board is comprised of four optometrists, one physician and one public member. The Board has a FY 2001-2002 operating budget of $130,500.
Laws 2001, chapter 331 allowed a licensee or a licensee’s attorney, ten business days prior to an informal interview to obtain access to the materials used by the Board in its investigation. This provision did not apply to a licensee whose investigation had been completed.
