HB 2139 makes investigation files confidential, prior to August 9, 2001, at the Board of Optometry (Board).

 

Current Status

HB 2139 was amended in the Health Committee to require the Board to allow access to the investigative file to a current or former licensee who was disciplined by the Board.   Eliminates the provision to make investigation files confidential, prior to August 9, 2001, at the Board of Optometry.

 

History

The Board examines and licenses approximately six hundred professional optometrists.  The Board is comprised of four optometrists, one physician and one public member.  The Board has a FY 2001-2002 operating budget of $130,500. 

 

Laws 2001, chapter 331 made all materials, documents and evidence associated with a pending or resolved complaint or investigation confidential from the date of enactment into law.  HB 2139 makes these investigation materials confidential prior to the August 9, 2001 date when the previous law was enacted.
