HB 2133 adds certain state air pollution control program information regarding violations and enforcement to the DEQ annual report pursuant to ARS section 49-105. Currently, only water quality and hazardous waste information for the categories are included.
HB 2133 was amended in the Environment Committee to allow for the posting of the information to the department’s internet website instead of submitting of a paper copy. HB 2133 passed the Retirement and Government Operations Committee unamended. The Environment amendment was adopted in the Committee of the Whole.
The DEQ annual report contains the following information for violations and enforcement:
- The number of site or facility inspections conducted, and the reasons for the inspection.
- The number of permits or approvals issued.
- The names of all persons who were the subject of an enforcement action due to a violation of a statutory, regulatory or administrative provision.
- A brief description of the number and nature of the violations committed by each person named above and a description of any enforcement action taken in response to the violations.
- A summary of all administrative penalties assessed pursuant to enforcement of the federal Safe Drinking Water Act and the violations of that act.
The Environment amendment was adopted in
the Committee of the Whole.
