HB 2124 strikes the requirement that elected precinct committeemen be in the county of the legislative district in which the legislative vacancy occurred.

 

Current Status

HB 2124 was amended in the Retirement and Government Operations committee to correct a technical error.  HB 2124 passed the Committee of the Whole unamended.

 

History

If a vacancy occurs in the legislature and the former member was of a formed political party and has at least 30 elected committeemen who are from precincts in that legislative district and in that county, the secretary of the state shall notify the state party chairman of the vacancy.   The state party chairman or the chairman’s designee shall give written notice of the meeting to fill the vacancy to all precinct committeemen of that political party from the precincts that are in the legislative districts and that are in the county in which the vacancy occurred. 

 

The elected precinct committeemen shall nominate three qualified electors to fill the vacancy who are from the same political party and reside in the same district and county as the person elected to or appointed to the office immediately before the vacancy.  The state party chairman of the appropriate political party shall then forward the names of the three nominees to the board of supervisors of the county of residence of the person elected or appointed to office immediately before the vacancy occurred.  The board of supervisors shall then appoint a person from the three nominees submitted. 

 

Provisions

·          Strikes the requirement that elected precinct committeemen that nominate qualified electors to fill legislative vacancies must be in the county of the legislative district in which the vacancy occurred.

 

·          Requires the board of supervisors of the county of residence in which the legislative vacancy occurred to appoint a citizen panel to nominate three qualified electors to fill the legislative vacancy.

 

·          Requires the three qualified electors, nominated by the citizen panel, to be from the same county in which the legislative vacancy occurred.

 

·          Repeals the stipulation if a legislative district is not entirely within one county and the citizen panel has submitted the names of three qualified electors, the board of supervisors of the county of residence of the person elected or appointed before the vacancy occurred shall fill the vacancy.

 

·          Makes technical and conforming changes.

HB 2124 was amended in the Retirement and Government Operations Committee as follows:
