HB 2123 allows United States Postal Inspectors to be cross-certified as federal peace officers, giving them the right to exercise all state law enforcement powers for one year. Also, cross-certified United States Postal Inspectors may enforce the criminal laws of the state by submitting the proper documentation to the state.

 

History

As defined by A.R.S. §13-105, a peace officer is a person who maintains public order and makes arrests as their duty to the law. The sheriff of each county decides on whether to allow cross-certification of federal peace officers in their county and creates policy on cross-certification. Maricopa County does allow cross-certification of federal peace officers by several federal agencies. Cross-certified federal peace officers must go through training and be reviewed by the Arizona peace officer standards and training board before their certification. The Arizona peace officer standards and training board prescribe the standards and qualifications for federal peace officer training.

 

Provisions

·          Adds the United States Postal Inspector to the list of employers able to cross-certify employees as federal peace officers. Also, if the United States Postal Inspector has submitted a written request to the state for certification and evidence of their certification, the employee is capable of enforcing the criminal laws of the state.
