HB 2122 allows a county board of supervisors to establish an improvement district including areas of an incorporated city or town, with the consent of the city's or town's governing body, for the purpose of maintaining, repairing, or disposing of any real or personal property necessary or convenient for district operation of a community center, park or recreational area.

History

Currently, a county board of supervisors may establish an improvement district, upon receiving a petition signed by a majority of the persons owning real property or by the owners of fifty-one per cent or more of the real property within the limits of the proposed district, in any unincorporated area, whether or not contiguous, for the purpose of making improvements or acquisitions within the district.  Current statute (A.R.S. § 48-909) stipulates that an improvement district may include areas of an incorporated city or town, with the consent of the city's or town's governing body, for the following purposes:

Ø        Maintaining or improving the streets of the district.

Ø        Acquiring, constructing, reconstructing or repairing waterworks for the delivery of water for domestic purposes, and of wells, ditches, canals, channels, conduits, pipelines and siphons, together with the necessary or usual appurtenances for carrying storm water or water from irrigation ditches, watercourses, streams or springs into, through or out of such district in, under, over or through any street, or any land of the district or any right-of-way granted or obtained for such purpose, either within or without the district limits.

Ø        Constructing, reconstructing or repairing breakwater levees or walls, protecting riverbanks or replacing riverbanks and supporting land so long that the district cooperates and coordinates its plans and activities with the county flood control district established in the county and any incorporated city or town in which the district is established.

Provisions

·          Authorizes a county board of supervisors to establish an improvement district in an incorporated city or town, with the consent of the city's or town's governing body, for the purpose of maintaining, repairing, or disposing of any real or personal property necessary or convenient for district operation for a community center, park or recreational area.
