HB 2107 authorizes a homeowners’ association or any other community based nonprofit organization to collect and salvage native plants in an unincorporated area of a county.
Laws 2000, Chapter 360, permits a homeowners’ association or any other community based nonprofit organization to collect and salvage native plants in a city or town without obtaining a permit, tag, seal or receipt from the Department of Agriculture or paying a fee. The law also stipulates that a homeowners’ association or any other community based nonprofit organization may only collect and salvage native plants for noncommercial salvage and only if their existence is threatened by intended destruction, by their location or by a change in land use.
