HB 2105 allows a county board of supervisors to establish an infill incentive district in any unincorporated area of a county and requires the county to adopt an infill incentive plan for the district.

History

Laws 2000, Fourth Special Session, Chapter 1, enacted the state’s Growing Smarter Plus Act (Act). The Act in general addressed local planning tools, citizen participation in planning, use and management of state trust lands, acquisition of open space and protection of private property rights.

Within the Act, Arizona Revised Statute (A.R.S.) § 9-499.10 was added to allow the governing bodies of cities or towns to designate infill incentive districts. This section also established an infill incentive plan to encourage redevelopment. SB 1564 would allow counties to create infill incentive districts.

Provisions

·              Allows a county board of supervisors to create an infill incentive district in any unincorporated area of a county if any three of the following  conditions exist:

Ø         a large number of vacant, older or dilapidated structures

Ø         a large number of vacant or underused parcels of property of small or inappropriate sizes or that are environmentally contaminated, owned by different owners, without the presence of development and investment activity compared to other areas in the county

Ø         a large number of parcels of property or buildings where nuisances occur or exist

Ø         a high occurrence of crime

Ø         a continuing decline in population

·              Stipulates that a board of supervisors must meet the following requirements before establishing an infill incentive district:

Ø         identify the boundaries of the district

Ø         hold a public hearing in the county supervisorial district where is the district is proposed

Ø         publish notice of the proposed district in a newspaper of general circulation in the county once a week for two consecutive weeks prior to the public hearing

Ø         notify all owners of private property and property managers of federal and state land in the proposed district through first class mail at least fifteen days prior to the public hearing

·              States that a board of supervisors may establish a county infill incentive district after the public hearing if it is apparent that the public interest, convenience and welfare will be justly served.

·              Requires the adoption of an infill incentive plan to help encourage redevelopment and establishes possible incentives which may include:

Ø         expedited zoning or rezoning procedures

Ø         expedited processing of plans and proposals

Ø         waivers of county and county improvement district fees and assessments for development activities

Ø         waivers of development standards and procedural requirements
