HB 2052 amends title 15 relating to higher education institutions, facilities and programs on Indian reservations.

 

A strike-everything amendment that relates to a tax exemption for prime contracting companies that operate on Indian reservations will be offered in the Native American Affairs Committee. 

 

Provisions of the proposed strike-everything amendment

·          Creates a transaction privilege, sales or other similar tax exemption for prime contracting companies that construct assets to provide electric transmission services on an Indian reservation.

·          Requires the amount of the credit that the Indian tribe allows to equal at least fifty per cent of the tax that is levied by the state.

·          Requires the taxpayer to claim the credit on forms prescribed and furnished by the Department of Revenue.

·          States that if the taxpayer fails to pay the tax due, plus any estimated tax liability, the taxpayer will not be allowed to claim the credit.

·          Defines contracting credit, electric transmission service, Indian tribe and prime contracting on the Indian reservation.
