AN ACT

ESTABLISHING THE PROCEDURE FOR CONSTRUCTION OF A VICTIMS' RIGHTS MEMORIAL IN WESLEY BOLIN PLAZA.

Be it enacted by the Legislature of the State of Arizona:

Section¦1. Victims' rights memorial; procedures

A. A victims' rights memorial may be placed in Wesley Bolin plaza pursuant to the following procedure:

1. The proponents shall submit a concept to the department of administration for the design, dimensions and proposed location of the memorial.

2. The department of administration shall review the concept and determine the most appropriate location that highlights the memorial and preserves the integrity of Wesley Bolin plaza.

3. The department of administration shall submit its review and recommendations to the legislative governmental mall commission established by section 41-1361, Arizona Revised Statutes, including recommendations regarding the department's ability to maintain the memorial.

4. After recommendations from the historical advisory commission established by section 41-1352, Arizona Revised Statutes, regarding the historical integrity of the memorial and after any necessary negotiations with the proponents, the legislative governmental mall commission, in consultation with the department of administration, shall approve the final design, dimensions, location and maintenance requirements of the memorial.

5. Before the beginning of construction of the memorial, the proponents shall enter into a contract with the department of administration that specifies the conditions of the design, dimensions, location and maintenance of the memorial and that includes a list of contractors and subcontractors that will be employed and a verification that all employees for the project are insured and that this state is indemnified against any liability in regard to the construction.

6. The memorial shall be completed and dedicated to this state within two years after the effective date of this act.

B. All fund-raising and contracts for artistic design and construction of the memorial are the sole responsibility of the proponents. This state shall not facilitate fund-raising or establish a state fund for the deposit of the monies. Public monies shall not be used for the design or construction of the memorial.

Sec. 2. Delayed repeal

This act is repealed from and after December 31, 2005.
