AN ACT
AMENDING SECTION 20-1368, ARIZONA REVISED STATUTES; RELATING TO HEALTH INSURANCE POLICIES.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 20-1368, Arizona Revised Statutes, is amended to read:
20-1368. Intoxicants and narcotics; exception
A. There may be a provision as follows: "Intoxicants and narcotics: The insurer shall not be liable for any loss sustained or contracted in consequence of the insured's being intoxicated or under the influence of any narcotic unless administered on the advice of a physician."
B. AN INSURER SHALL NOT USE THE PROVISIONS OF SUBSECTION A OF THIS SECTION WITH RESPECT TO A DISABILITY POLICY.
C. FOR THE PURPOSES OF THIS SECTION, DISABILITY POLICY DOES NOT INCLUDE A LONG-TERM CARE INSURANCE POLICY AS DEFINED IN SECTION 20-1691 OR LIMITED BENEFIT COVERAGE AS DEFINED IN SECTION 20-1137, EXCEPT FOR AN ACCIDENT ONLY POLICY OR A FIXED OR HOSPITAL INDEMNITY POLICY.
