AN ACT
AMENDING SECTION 20-1368, ARIZONA REVISED STATUTES; RELATING TO HEALTH INSURANCE POLICIES.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 20-1368, Arizona Revised Statutes, is amended to read:
20-1368. Intoxicants and narcotics; exception; definition
A. There may be a provision as follows: "Intoxicants and narcotics: The insurer shall not be liable for any loss sustained or contracted in consequence of the insured's being intoxicated or under the influence of any narcotic unless administered on the advice of a physician."
B. AN INSURER SHALL NOT USE THE PROVISIONS OF SUBSECTION A WITH RESPECT TO A MEDICAL EXPENSE POLICY.
C. FOR THE PURPOSES OF THIS SECTION, "MEDICAL EXPENSE POLICY" MEANS AN ACCIDENT AND SICKNESS INSURANCE POLICY THAT PROVIDES HOSPITAL, MEDICAL AND SURGICAL EXPENSE COVERAGE.
