Purpose
Increases the amount of time from 30 to 60 days that a municipality must give advance notice of intention to assess a new or increased development fee.
Background
Under current law, a municipality may assess a fee to offset costs associated with providing public services to a development. The municipality is required to give a 30-day advance notice of the intention to assess a new or increased development fee. A written report must also be released to the public containing documentation that supports the proposed fee. After the notice of intention to assess a development fee has expired, the municipality must conduct a public hearing within 14 days prior to scheduled adoption of the new or increased development fee. Concerns have been expressed that the 30 days under current law is not enough time. The studies conducted on the proposed fee are very lengthy and a longer time frame would allow for more thoroughness.
There is no fiscal impact to the state general fund associated with this legislation
Provisions
1. Increases the amount of time from 30 to 60 days that a municipality must give advance notice of intention to assess a new or increased development fee.
2. Provides for a general effective date.
