special districts; boundary changes

 

Purpose

 

Makes a variety of changes to fire district, community park maintenance districts, sanitary districts and hospital district statutes relating to formation and boundary changes of the district and signature requirements.

 

Background

 

Presently, fire districts, community park maintenance districts, sanitary districts and hospital districts can only include new areas of land that are contiguous to the district.  This legislation specifies that land that is contiguous to a district if the contiguity is limited due to intervening federal, state or political subdivision land.  In addition, this legislation makes a variety of clarifications in related statutes.

 

This legislation has no direct fiscal impact to the state general fund.

 

Provisions

 

1.      Allows increases in a fire district, community park maintenance district, sanitary district or hospital district area only if the proposed additions would be contiguous to the existing district and would not result in the district surrounding a county island.  Specifies that any federal, state or political subdivision land, other than municipal, that exists between the territory to be added and the existing district does not result in the addition’s lack of contiguity.

 

2.      Allows any parcel to be added to such districts.

 

3.      Makes clarifying changes relating to who must sign the differing petitions required to create, or change the boundaries of, a fire district, community park maintenance district, sanitary district or hospital district.

 

4.      Allows property owner district petitions to be signed by one owner of a property with multiple ownership, rather than a property held in joint tenancy.

 

5.      Stipulates that petitions to increase the size of a district must meet statutory verification of signature requirements.

 

6.      Makes technical and conforming changes.

 

7.      Provides for a general effective date.
