superior court clerk; removing receivables

 

Purpose

 

            Authorizes the clerk of the superior court to remove specified uncollectible debts from the court’s accounting system.

 

Background

 

            Under current law the clerk of the superior court collects fees that are distributed to various accounts and funds. This creates shared ownership of the fees that are uncollected.  The clerk has no ownership or control over the fees and cannot remove uncollectible debts from the court’s accounts without the concurrence of the owners of the fees.  According to the Arizona Association of Superior Courts Clerks, this process is both time consuming to coordinate and carries a significant administrative cost to the court.

 

            H.B. 2275 authorizes the clerk of the superior court to remove from the court’s accounting system specific debts that were unable to be collected after one year.  This bill is identical to S.B. 1034 that passed the Senate.

 

The fiscal impact of the amount of funds returned to the county from collection agencies or the Department of Revenue is undeterminable at this time.

 

Provisions

 

1.      Authorizes the clerk of the superior court to remove specific uncollected debts from the court’s accounting system if the clerk follows specified procedures, including waiting at least one year while a collection agency attempts to collect the debt.

 

2.      Provides for a general effective date.
