FACT SHEET FOR H.B. 2270

 

appropriations; drug court funding

 

Purpose

 

            Appropriates approximately $2.1 million from the state general fund in FY 2001-2002 to the superior court probation services program to fund adult and juvenile drug courts and adult driving under the influence (DUI) courts.

 

Background

 

            Pursuant to A.R.S. section 13-3422, the presiding judge of each superior court may establish a drug court program for the purpose of prosecuting, adjudicating and treating drug dependent persons.  In order to enter the program, individuals must meet the criteria and guidelines that are developed and agreed upon by the presiding judge and the prosecutor.

 

            The Administrative Office of the Courts (AOC) reports that the state and national average cost of the drug court treatment component is between $1,200 and $3,500 per participant.  As of November 2000, there were 1,066 participants statewide and 984 individuals had graduated from the program.

 

            AOC states there is no current state appropriation to the drug courts earmarked for drug treatment programs and that federal seed grant funding has lapsed or will lapse this year.  Drug court treatment programs are currently funded partly through the drug treatment enhancement fund, court fees and by counties.  H.B. 2270 appropriates approximately $2.1 million from the state general fund in FY 2001-2002 to fund adult and juvenile drug courts and adult DUI courts.

 

Provisions

 

1.      Appropriates $1,821,350 in FY 2001-2002 from the state general fund to the superior court adult probation services community punishment program to fund drug court and DUI court programs and to provide drug treatment services to participants in these programs.

 

2.      Appropriates $341,300 in FY 2001-2002 from the state general fund to the superior court juvenile probation services program to fund juvenile drug courts and provide drug treatment services to drug court participants.

 

3.      Exempts appropriations from lapsing.

 

4.      Provides a general effective date.
