Purpose:
Increases fines for driving
under the influence (DUI) violations.
Background:
Under current law, the
penalty for a DUI violation includes a mandatory jail sentence of at least 10
days and a fine of at least $250. For a second DUI violation within 60 months,
the penalty includes a mandatory jail sentence of at least 90 days, a fine of
at least $500 and a revocation of driving privileges for one year.
Similarly, if a person is
convicted of extreme DUI the penalty includes a mandatory jail sentence of at
least 30 days, a fine of at least $250, and an additional $250 assessment to be
deposited into the DUI abatement fund.
For a second extreme DUI violation within 60 months of any DUI
violation, the penalty includes a mandatory jail sentence of at least 120 days,
a fine of at least $500, the additional $250 assessment, and a revocation of
driving privileges for one year.
H.B. 2182 increases the
fines for first time and repeat DUI and extreme DUI violations.
There is no anticipated
impact to the state general fund associated with this bill.
Provisions:
1. Increases, from $250 to $500, the fine assessed for DUI violations and extreme DUI violations.
2. Increases, from $500 to $750, the fine assessed for a second DUI violation within 60 months of another DUI, extreme DUI, or aggravated DUI conviction.
3. Increases, from $500 to $1,000, the fine assessed for an extreme DUI violation within 60 months of another DUI, extreme DUI, or aggravated DUI conviction.
4. Provides for a general effective date.
