Requires state agency web sites
to contain a privacy policy statement to disclose information
gathering and dissemination practices related to the internet.
According to the Government Information Technology Agency (GITA), five agencies have privacy policy disclaimers. When online, personally identifying information may be gathered through a variety of means without the user’s knowledge.
While the exact fiscal impact of this legislation is unknown, no additional costs should develop relating to the establishment of privacy policy statements.
1. Requires state agency web sites to contain a privacy policy statement to disclose information gathering and dissemination practices related to the internet.
2. Establishes minimum elements of the privacy policy:
a) What services the site provides.
b) The information the agency obtains from individuals online.
c) A person’s option to choose to proceed with the transaction and any alternatives available.
d) How the agency uses the information.
e) Whether and under what circumstances the agency discloses the obtained information to other entities and persons.
f) Whether other entities or persons are collecting information through the agency web site.
g) A general description of the security measures in place to protect a person’s information without compromising the integrity of the security measures.
3. Prescribes definitions.
4. Provides for a general effective date.
