Purpose
Eliminates the state
asbestos training and certification program.
Background
The asbestos training and
certification program was established in statute in 1991 under the division of
occupational safety and health of the Industrial Commission of Arizona
(Commission). The statutes authorize
the Commission to develop and implement standards for asbestos abatement
certification and training requirements, develop and implement standards for
approval of asbestos abatement training courses and impose fees for
certification and issue photo identification cards to course participants.
In 1994, the federal
Occupational Safety and Health Administration (OSHA)
asbestos abatement standard was revised.
The federal standard is more comprehensive and more stringent than the
state program. According to the
Commission, the federal standard was adopted by the Commission and has been used
since its inception, rendering the state program unnecessary and obsolete. The
only provision of the state program not addressed in the federal standard is
the imposition of fees for the certification of training programs. However, since the inception of the federal
standard, the state program has not been utilized and no fees have been
collected.
There is no anticipated
fiscal impact associated with this bill.
Provisions
1. Eliminates the asbestos training and certification program.
2. Provides for a general effective date.
