SUBJECT:       Strike Everything Amendment to S.B. 1238

                                                                                                                                                           

           

 

Purpose

 

             Requires the Arizona Department of Corrections (ADC) to develop and implement a residential drug treatment pilot program, permits a judge to order a person convicted of any specified nonviolent offense to a sentence in a residential facility that provides services through the pilot program and appropriates $2.2 million from the state general fund in FY 2001-2002 to ADC to fund a facility under the program.

 

Background

 

The amendment allows a person convicted of a nonviolent offense to be sentenced to a residential drug treatment facility for drug offenses, alcohol offenses or other offenses resulting from the person’s drug use.

 

The amendment appropriates $2.2 million from the state general fund in FY 2001-2002 to ADC to fund a residential facility that is licensed by the Department of Health Services (DHS) and that provides drug treatment services.

 

Provision

 

1.      Requires ADC to develop and implement a pilot program for drug treatment services, to develop a policy to establish financial self-sufficiency of the pilot program and to contract with a private entity inside or outside of Arizona to provide services under the program.

 

2.      Requires any facility under the pilot program to be licensed as a level two or level three behavioral health residential facility by DHS and requires program participants to live at the facility for the duration of the person’s treatment.

 

3.      Allows a judge to sentence a person to a facility under the pilot program if:

 

§         the offense was a specified nonviolent offense involving drugs or alcohol or the offense resulted from the person’s drug use,  and 

§         the person is not otherwise required to register with a sheriff.

 

4.      Establishes a pilot program for a specified purpose and repeals the program on July 1, 2004.

 

5.      Provides for a general effective date.
