Assigned to FS & APPROP                                                                                                        FOR COMMITTEE

ARIZONA STATE SENATE

Phoenix, Arizona

FACT SHEET FOR S.B. 1190

appropriations; spousal maintenance

Purpose

Appropriates $3 million from the state general fund in each of FY 2001-2002 and FY 2002-2003 to the Department of Economic Security (DES) to hire full-time employees for enhanced collection of maintenance for spouses without dependent children.

Background

Currently, Arizona does not have a maintenance support enforcement program for spouses without dependent children.  The Child Support Enforcement Unit in DES collects spousal support when it is part of a child support enforcement order.  In other cases, the spouse must go through the court system to remedy problems with the collection of spousal maintenance.  Other states follow the same protocol as Arizona regarding spousal maintenance enforcement, according to the National Conference of State Legislatures.

S.B. 1190 appropriates $3 million from the state general fund in each of FY 2001-2002 and FY 2002-2003 to DES to hire full-time employees to collect spousal maintenance for spouses without dependent children.

Provisions

1.      Appropriates $3 million from the state general fund in each of FY 2001-2002 and FY 2002-2003 to DES to hire full-time employees for enhanced collection of spousal maintenance for spouses without dependent children.  Exempts the appropriation from lapsing.

2.      Provides for a general effective date.
