Purpose

 

            Requires the State Board of Appraisal to define and explain by rule the stages of the disciplinary process for licensed and certified appraisers.  Requires the Board to include more detail about the process of enforcement in rule.   Requires the Board to take disciplinary or remedial action after determining that a state licensed or state certified appraiser is guilty of a violation.

 

Background

 

            In 1998 the Governor’s Regulatory Review Council approved a rules package with the understanding that there would be further effort to more define the process.  The current rules, adopted in 1998, were supported my most of the Arizona appraisal organizations.  Currently, there has been no further clarification of the rules process.  The current rules provide a brief overview of the process, but do not provide the user with adequate guidance to understand the process.

 

            S.B. 1160 requires that the Board include more detail about the process of enforcement in rule. The provisions found in this legislation are similar to the provisions of S.B. 1359.

 

             There is no fiscal impact to the state general fund associated with this legislation.

 

Provisions

 

1.      Requires the State Board of Appraisals to define and explain by rule the stages of the disciplinary process for licensed and certified appraisers.

 

2.      Requires the Board to include more detail about the process of enforcement in rule.

 

3.      Requires the Board to take disciplinary or remedial action after determining that a state licensed or state certified appraiser is guilty of a violation.

 

4.      Makes technical changes

 

5.      Provides for a general effective date.
