tax liens; notice of sale

 

Purpose

 

            Reduces the number of times from two to one a county treasurer must post the list of delinquent tax liens and notice of sale in a county newspaper of general circulation.  Requires the county newspaper to post the list and notice on the Internet, specifically on a web site that posts the legal notices of at least ten Arizona newspapers.

 

Background

 

            In an attempt to reach a larger number of people, many industries have begun using the Internet to publish information.  Previous legislation has given various groups the ability to use the Internet as an additional means to post information.  For instance, in 1998 S.B. 1333 was passed requiring the Department of Public Safety to establish a sex offender web site.  In addition, Arizona Revised Statutes 16-913 allows for campaign finance reports to be posted on the Internet.

 

            At the present time, county treasurers must post a copy of a delinquent tax list and notice of sale near the outer door of their office and in a newspaper published in their county.  In rural areas and smaller counties, county newspapers do not always have broad exposure.  Many people in these areas read larger newspapers from other counties and therefore are not aware of the listing for their county.  Furthermore, the cost of publishing the list in a county newspaper can be costly for smaller counties.

 

            The fiscal impact of this legislation is unknown at this time.

 

Provisions

 

1.      Reduces the number of times a county treasurer must post the list of delinquent tax liens and notice of sale from twice to once.  Requires the list be published at least two weeks but no more than three weeks before the date of sale.

 

2.      Requires the newspaper that the list is posted in to post the list and notice on a web site that posts the legal notices of at least ten Arizona newspapers.  The list will be available from the publication date through March 1 of the current year.

 


3.      Provides for a general effective date.

 

Amendments Adopted by Committee

 

1.      Removes option of the county treasurer to post tax lien list on the Internet or in a newspaper.

 

2.      Reduces from twice to once the number of times a county newspaper must publish the list and notice in a county newspaper.

 

3.      Requires the county newspaper to post the list and notice on a web site from the first date of publication through March 1 of the current year.
