REVISED
Prohibits the juvenile court
from consolidating delinquency proceedings with other proceedings that do not
involve delinquency.
Current law permits the
juvenile court to consolidate any matters within the juvenile court with one
exception. Criminal proceedings filed
in another division of the superior court may not be consolidated with matters
in the juvenile court.
S.B. 1047 adds an additional
restriction to consolidation. The bill
prohibits the juvenile court from consolidating delinquency proceedings with
other proceedings that do not involve delinquency.
The juvenile court hears both
delinquency matters and cases relating to domestic relations, such as custody
and child welfare. The Maricopa County
Attorney’s Office believes that these types of cases should not be
consolidated.
The fiscal impact is
undeterminable at this time.
1. Prohibits the juvenile court from consolidating delinquency proceedings with other proceedings that do not involve delinquency, unless the delinquency proceeding is not heard at the same time or in the same hearing as a nondelinquency proceeding.
2. Makes technical changes.
3. Provides for a general effective date.
Amendments Adopted by Committee of the Whole
Allows
consolidation if the delinquency
proceeding is not heard simultaneously with the nondelinquency
proceeding.
