motorcycle safety fund; establishment

 

Purpose

 

Establishes the motorcycle safety fund and redirects one dollar of each motorcycle registration fee from the state highway fund to the motorcycle safety fund for motorcycle safety and awareness.

 

Background

 

The Arizona Motorcycle Safety Program (AMSP) was established in 1981 and is designed to address the need for motorcycle safety and awareness around the State of Arizona.   The program is administered by the Motor Vehicle Division (MVD) and is recognized by both the National Highway Safety Administration and the Motorcycle Safety Foundation, a nonprofit organization.   Currently, the AMSP is funded by a one-dollar fee from the nine-dollar Arizona motorcycle registration.  These monies are deposited in the state highway fund to fund various programs geared towards motorcycle safety and education.   According to MVD, 82,313 motorcycles were registered in FY 1999-2000.

 

Laws 1996, Chapter 76 established the state motorcycle education fund to implement a motorcycle testing program and a voluntary motorcycle education program with one dollar of each motorcycle registration fee.  Laws 1997, Chapter 1 eliminated the state motorcycle education fund and redirected the registration fee deposits to the state highway fund.

           

            There is no known fiscal impact associated with this legislation.  

 

Provisions

 

1.      Creates the motorcycle safety fund (MSF) and diverts one dollar from each motorcycle registration from the state highway fund to the motorcycle safety fund through June 30, 2005. 

 

2.      Deposits grants, donations or monies from gifts into the motorcycle safety fund.

 

3.      Clarifies that monies from the MSF are to be used for programs including voluntary motorcycle education, motorcycle awareness and costs associated with these programs.         

 

4.      Exempts the motorcycle safety fund from lapsing of appropriations.

 

5.      Reverts monies in the excess of $150,000 from the MSF to the state highway fund. 

 

6.      Requires the Director of the Arizona Department of Transportation to administer the fund.

 


7.      Makes technical and conforming changes.

 

8.      Provides for a general effective date.
