nuclear emergency appropriations and assessment

 

Purpose

 

Appropriates, from the state general fund, $924,778 for FY 2001-2002 and $940,611 for FY 2002-2003 to the nuclear emergency management fund and assesses the same amounts, plus interest, against each consortium of public service corporations and municipal corporations engaged in constructing or operating a commercial nuclear generating station.  Contains an emergency clause.

 

Background

 

State law requires the Legislature to levy, on a biennial basis, an assessment against each consortium of public service corporations and municipal corporations engaged in constructing or operating a commercial nuclear generating plant in the state.  This assessment provides for the development and maintenance of a state plan for off-site response to an emergency caused by an accident at a commercial nuclear generating station and provides for the equipment, personnel, facilities, training and testing necessary to comply with federally prescribed criteria.  The Department of Emergency and Military Affair=s (DEMA) division of emergency management has been designated as the lead agency for Arizona with primary responsibility for development of the state plan for off-site response to a commercial nuclear emergency.

 

DEMA is required to make a recommendation for the amount of the biennial appropriation and assessment.  The Legislature then appropriates to the nuclear emergency management fund the amount necessary to develop, maintain and support the state response plan.  The assessment against each consortium of public service and municipal corporations offsets the legislative appropriations.

 

This legislation provides the biennial appropriation and assessment for the support of the state response plan for commercial nuclear emergencies.  Because the assessments offset the appropriation, no fiscal impact is anticipated.

 

Provisions

 

1.      Appropriates, from the state general fund, $924,778 and 8.5 FTE's for FY 2001-2002 and $940,611 and 8.5 FTE's for FY 2002-2003 to the nuclear emergency management fund to be distributed to the following agencies:

 

      -         DEMA=s emergency management division (4.5 FTE's):

FY 2001-2002 -  $251,828

FY 2002-2003 -  $256,147


-         Radiation Regulatory Agency for programs relating to off-site nuclear emergency response plans (4 FTE's):

FY 2001-2002 -  $451,600

FY 2002-2003 -  $451,600

 


-           DEMA=s emergency management division for disbursement to Maricopa County for its assigned responsibilities under the off-site nuclear emergency response plan:

FY 2001-2002 -  $189,799

FY 2002-2003 -  $201,313

 

-           DEMA’s emergency management division for disbursement to the Town of Buckeye for its assigned responsibilities under the off-site nuclear emergency response plan:

                        FY 2001-2002 - $31,551

                        FY 2002-2003 - $31,551

 

2.      Assesses the sums of $924,778 for FY 2001-2002 and $940,611 for FY 2002-2003 plus any applicable interest, against each consortium of public service corporations and municipal corporations engaged in constructing or operating a commercial nuclear generating station.

 

3.      Contains an emergency clause.
