Requires colleges that are owned and operated by Native American tribes to report student enrollment to the State Board of Directors for Community Colleges in order to receive Proposition 301 Funds.

 

Background

Proposition 301 requires that one twelfth of the monies shall be given to colleges owned by Native American tribes and operated on Indian reservations for the purpose of workforce development. Proposition 301 does not require Native American colleges to report their full time equivalent student enrollment (FTESE) to the State Board of Directors for Community colleges, in order to qualify for the funds.

 

Provisions

·                      Broadens the definition of community colleges to include all colleges owned by a Native American tribe and operated on the tribe’s reservation.

·                      Requires the Native American tribe to report its college’s FTESE to the State Board of Directors for Community Colleges by June 30 each year, in order to qualify for the following year’s workforce development funds.

·                      Requires the qualifying Native American tribe to use the same accounting procedures prescribed by the State Board of Community Colleges for calculating its full time equivalent student enrollment for colleges under its jurisdiction.

·                      Contains a Proposition 105 clause, which requires the affirmative vote of at least three-fourths of the members of each house of the legislature.
