SB 1327 allows public street and park lighting improvement districts to purchase energy in general rather than just electricity.

History

Current statute allows improvement districts to be formed for the sole purpose of purchasing electricity for the lighting of the public streets and parks of the improvement district. Although electricity is the primary form of energy used to power the lights, other forms of energy such as natural gas and photovoltaic are currently available for use. SB 1327 gives lighting improvement districts the option of purchasing these alternative types of lighting energy.

Provisions

·              Expands the authority of street and park lighting improvement districts from purchasing electricity to purchasing energy in general.

·              Contains other technical and conforming changes.

SB 1327 was amended in the Public Institutions & Rural Affairs Committee as follows:

·              Clarifies that a street and park lighting improvement district may not generate energy.

·              Stipulates that a lighting district formed after the effective date of this act shall not make an assessment against the property of a public service corporation located within the district.

 

SB 1327 passed the Committee on Energy Utilities and Technology unamended.
