SB 1323 exempts schools from having to follow a prehospital medical care directive to withhold cardiopulmonary resuscitation from a person in their care, unless the school is a licensed health care institution.
A prehospital medical care directive allows a person to order that cardiopulmonary resuscitation not be used in the event that the person goes into cardiac arrest. An "orange form" is typically used in retirement communities and nursing homes to convey the directive to caregivers. In recent years, access to education has been increased for students with disabilities and handicaps. The result has been children in medically fragile states being enrolled in school, and therefore being at risk of going into cardiac arrest while at school. A concern exists about the legal and social implications of having a student go into cardiac arrest at school and not receive any resuscitation efforts.
