SB 1320 requires an agency of a sunset hearing to prepare a written statement for presentation at the sunset hearing.

 

History

The Arizona Legislature found that state government actions had caused an increase in the number of agencies whose development occurred without sufficient legislative oversight and found the need to continually review and revise state government in response to these developing needs. Therefore, the legislature established a system for the termination, study, review, continuation or reestablishment of such agencies in order to be in a better position to evaluate the need for the continued existence of current and future agencies, departments, boards, commissions, institutions and programs of the state.   

 

Sunset review is the systematic evaluation by the committee of reference to determine if the merits of a program justify its continuation rather than termination, or its continuation at a level less than or greater than the existing level.  The review must be coordinated with the performance audit procedures of the auditor general or of the committees of reference, whichever is appropriate.

 

Current law requires each standing committee of both houses of the legislature to appoint a subcommittee of five members which will constitute a committee of reference in their respective subject matter areas.   Upon receipt of the preliminary sunset review report, the committee of reference must hold at least one public hearing to receive testimony from the public and the officials of the agency.  After final consideration, the committee of reference is required to deliver the final sunset review report of its recommendations to the committee, the Legislature, the governor, the Auditor General and the affected agency by December 1 and the report must include recommendations specified by statute.

 

·        Requires the final sunset review report by the committee of reference to include a written statement prepared by the agency involved.

 

·        Requires an agency involved in a sunset hearing to prepare a presentation for the first public meeting that addresses the elements of the agency written statement, which is required within the sunset review report.
