SB 1310 requires the Board of Medical Examiners (BOMEX) to consider all previous non-disciplinary and disciplinary actions against a licensee when determining the appropriate disciplinary action.

 

History

The Board of Medical Examiners is responsible for protecting the public through the licensure and regulation of approximately 15,000 physicians and 700 physician assistants statewide.  BOMEX receives more than 1,000 complaints each year.

 

According to BOMEX, approximately 2,887 physicians have received more than one complaint and 1,832 have received three or more. The Board members are currently provided a complete history of non-disciplinary and disciplinary actions taken against licensee to be used for determining a case.  While BOMEX asserts that previous non-disciplinary and disciplinary actions are factored into the adjudication of each case, SB 1310 ensures that previous actions will be considered.

 

Provisions

·                      Requires BOMEX to consider all previous non-disciplinary and disciplinary actions against a licensee when determining the appropriate disciplinary action.
