The proposed strike-everything amendment to SB 1297 exempts peace officers from paying a concealed weapon permit (permit) fee, allows peace officers to have lifetime permits and requires the Department of Public Safety (DPS) to establish rules regarding recognition of other states’ concealed weapon law requirements.

 

History

Current law requires all concealed weapons applicants to meet specific requirements and to complete a firearm safety training program approved by DPS prior to submitting an application. The applicant is also required to submit two sets of fingerprints and a reasonable application fee.  Statute requires concealed weapons permits to be renewed every four years, and a criminal history check must be performed before the permit is renewed.  Active duty Arizona peace officers who are standard and training board certified or federally credentialed or who are honorably retired as a federal, state or local peace officers with a minimum of 10 years of service are exempt from completing the firearms safety training program.

 

Current law also requires DPS to enter into reciprocal agreements with states that have substantially similar concealed weapons laws.  The purpose is to allow a license or permit issued by either state to be used within the jurisdiction of either state.

 

Provisions

·                      Exempts peace officers from paying permit fees and allows a concealed weapon permit to remain valid for the life of a peace officer, if it is issued to one of the following:

1)      Active duty Arizona peace officer standards and training board certified or federally credentialed peace officers.

2)      Honorable retired federal, state or local peace officers with at least 10 years of service.

·                      Requires DPS to compile a list of and recognize states whose concealed weapon law requirements meet specific criteria, including:

1)      A resident of the state or a United States citizen.

2)      21 years of age or older.

3)      Not under indictment for, or been convicted of, any felony in the United States or any other country.

4)      Not under indictment for or convicted of any misdemeanor related to domestic violence.

5)      Does not suffer from mental illness or has not been adjudicated mentally incompetent or committed to a mental institution.

6)      Not unlawfully present in the United States.

7)      Satisfactory completion of a firearms safety training program.

·                      Specifies that states meeting the specific recognition criteria will be added to a list of recognized states for the purpose of establishing a basis under which a concealed weapon license or permit issued by a recognized state may be used in this state.

·                      Makes technical, conforming and clarifying changes.
