SB 1291 expands AHCCCS services to include a greater amount of people with disabilities.

 

SB 1291 has a proposed strike-everything amendment requiring all casualty insurers that require an insured or claimant to undergo a medical examination by a physician to notify the Director of the Department of Insurance (DOI) and request the Director to choose a physician to perform an independent medical examination (IME).  The Director shall randomly choose the physician from a list compiled by the Director of physicians willing to perform independent medical examinations.

 

Provisions

 

·                      Requires a casualty insurer that makes an insured or claimant undergo a medical examination by a physician notify the Director and request the Director to choose a physician to perform an IME.

·                      Requires the Director to compile a list of physicians willing to perform IME’s.

·                      Requires the Director to respond to IME requests by a casualty insurer in a timely manner.

·                      Allows the casualty insurer the right to refuse the Director’s first random physician choice for the IME.

·                      Requires the physician performing an IME to be within the same scope of practice as the insured’s or claimant’s treating physician.

·                      Requires the Director to determine the amount a physician shall be reimbursed for performing an IME.

·                      States that DOI is immune from liability when acting within their scope of authority pursuant to this bill.

·                      Appropriates an amount to be determined in FY 2001-2002 to DOI for compiling a list of physicians willing to perform IME’s and administering the IME process prescribed in this bill.

 

The motion to adopt the strike-everything amendment in the Financial Institutions and Insurance Committee failed.

SB 1291 failed in the Financial Institutions and Insurance Committee.
