Senate Bill 1273 entitles a utility company to reimbursement of utility relocation costs in federal transportation projects.

 

The Strike-everything amendment to SB 1273 allows property owners, condominium associations and homeowners’ associations to request local law enforcement authorities to enforce traffic laws on property under the jurisdiction of the association or owner.

 

History

With the exception of enforcement of traffic laws pertaining to accidents involving death or personal injuries, reckless driving and driving under the influence, current statute grants state and local law enforcement the authority to enforce traffic laws only on public highways.  The owner of real property that is used by the public for purposes of vehicular travel by permission of the owner is allowed to prohibit the use and require other, different or additional conditions than specified traffic laws.

 

Provisions

·                      Allows a local authority to enforce traffic laws and local ordinances upon written request of property owners, condominium associations and homeowners’ associations.

·                      Prescribes that local traffic control devices on the property conform to the uniform system of traffic control devices adopted by the Arizona Department of Transportation (ADOT).

·                      Requires the property owner to pay the costs for traffic control devices and any other associated implementation costs.

 

·                      Allows the local authority to terminate the agreement if construction and engineering standards prescribed by the local authority are not maintained by the property owner or association.

·                      Allows the membership of a condominium association or a homeowners’ association to vote to revoke the written request if 50 percent of the membership plus one member of the association vote for revocation.

·                      Requires the association to submit the results of the vote to local authority upon revocation.

·                      Contains conforming changes.
