SB 1232 allows a retired Elected Officials Retirement Plan (EORP) member who is appointed to the same office from which the member retired to receive a pension.

 

History

Currently, a retired EORP member that was an elected official cannot receive a pension, have member or employer contributions made or accrue credited services, if the member becomes an elected official of the same office from which the member retired.  However, if the retired EORP member becomes an elected official of another office, the member can receive a pension, but contributions and credited service does not resume.

 

Provisions

·                      Clarifies that a retired EORP member who becomes an elected official of the same office from which the member retired by reason of election or reelection cannot receive a pension, have member or employer contributions made or accrue credited service.

 

·                      Effective retroactively August 30, 1999.
