SB 1178 provides that if the school district did not participate in the energy conservation measures program during school year 2000-2001, the school district is ineligible to adjust their budget limit for energy conservation measures.

 

History

 

Current law allows for a school district energy conservation measure program to reduce excess utility costs.  If a school district has excess utility costs, one-half of the energy savings resulting from the energy conservation measures can be added to the school district’s general budget limit and the remaining one-half of the reduction is required to be used to offset local property taxes within each district.  Energy cost savings are based on the excess utility costs for a base year, which is the fiscal year prior to implementation of the program.  The energy conservation measure program is repealed on July 1, 2005.  Furthermore, Proposition 301 repeals the ability for school districts to budget outside of the revenue control limit for excess utilities at the end of FY 2009.

 

SB 1178 provides that if a school district did not participate in energy conservation measures during school year 2000-2001, then the school districts are ineligible to adjust the budget limit for energy conservation measures.  Therefore, only those school districts with current programs can participate in the program until the repeal of the program on July 1, 2005.

 

Provisions

·                      Provides that school districts are ineligible to adjust their budget limit for energy conservation measures if the school district did not participate in the energy conservation measures during school year 2000-2001.
