SB 1160 allows school district governing boards to provide and charge for goods or services to the community at large.

 

SB 1160 has a proposed strike-everything amendment that requires the State Board of Appraisal explain by rule the steps associated with the administrative procedures for disciplining licensed and certified appraisers.

 

History

The State Board of Appraisal is responsible for the licensure and regulation of real estate appraisers.  Prior to 1991, appraisers were not licensed.  The Board enforces a code of professional responsibility called the Uniform Standards of Professional Appraisal Practice (USPAP).  The Appraisal Standards Board (ASB) promulgates the USPAP on behalf of appraisers and users of appraisal services. 

In order to be licensed as a real estate appraiser in Arizona, an applicant must comply with the requirements of Chapter 36, Title 32, A.R.S. and the Arizona Board of Appraisal Rules.  Applicants must acquire 2,000 hours of appraisal experience gained in not less than 18 months.  In addition, an applicant must complete 90 hours of post secondary education training and pass a national exam.  After licensure, real estate appraisers are required to receive continuing education credit every two years.

 

Provisions

·        Requires that the State Board of Appraisal explain by rule the steps associated with the administrative procedures for disciplining licensed and certified appraisers.  The explanation shall include:

1)      the minimum criteria for accepting a complaint against an appraiser;

2)      the process used in investigating allegations;

3)      hearing procedures, including the rights of both the board and the person who allegedly committed a violation;

4)      the criteria used in determining the board’s actions; and

5)      information to the public and appraisers relating to actions for violations.

·        Allows the Board to recommend a reprimand for an appraiser or suspend/revoke his/her                            license following a finding that the appraiser is guilty of a violation.

·        Makes technical corrections.

 

The strike-everything amendment was adopted in the Financial Institutions and Insurance Committee with the following changes:

·        Requires the Board to take disciplinary or remedial action if a state licensed or state certified appraiser is found guilty of a violation.

·        Contains a delayed effective date of August 1, 2002.

·        Makes technical changes.

 

SB 1160 passed the Committee of the Whole as amended in the Financial Institutions and Insurance Committee.
