SB 1159 requires that fingerprints for criminal background checks for adoption shall be scanned and transmitted accordingly between departments, subject to the availability of electronic fingerprint technology, and appropriates $2 million for the procurement of an electronic fingerprint identification system.

 

History

Currently DES utilizes electronic fingerprint technology that captures a single fingerprint, while all ten fingerprints are needed for DPS and FBI criminal background checks.

 

Provisions

·                      Stipulates that if electronic fingerprint technology is available, fingerprints may be scanned and transmitted to DPS by the following parties:

·                      The division, meaning DES.

·                      The agency, meaning a person other than the division licensed by the division to place children for adoption, including an attorney or law firm.

·                      An officer of the court.

·                      A designee of the division, agency or court.

·                      Requires DPS to transmit any fingerprints received as a computerized image to the Integrated Automated Fingerprint Identification System of the FBI National Crime Information Center, if the department is linked to that system.

·                      Appropriates $2,000,000 in FY 2001-02 from the Arizona corrections industries fund to DPS to obtain automated applicant fingerprint transmission equipment.

·                      Exempts the appropriation from lapsing until June 30, 2003, at which time unexpended and unencumbered monies will revert to the state general fund.

·                      Makes technical and conforming changes.
