SB 1146 authorizes the Arizona Health Care Cost Containment System (AHCCCS) to accept delegation from the Department of Health Services (DHS) to enforce standards for adult foster care providers in the Arizona long-term care system (ALTCS).  

 

History

Current law requires the director of DHS to provide guidelines for counties to use in establishing contract standards for ALTCS adult foster care providers.  In addition, the director shall adopt rules for the counties to use for prescribing the minimum standards for the adult foster care providers and conform the rules to federal standards.  The director is required to delegate to each applicable county the authority to enforce these rules.  SB 1146 adds AHCCCS as a permissible delegate for the acceptance of authority to establish and enforce rules for the adult foster care providers.    

 

Provisions

·                      Allows DHS to delegate the authority for prescribing and enforcing ALTCS adult foster care standards to the AHCCCS administration.

·                      Authorizes the AHCCCS administration to accept the delegation from DHS.

·                      Makes technical and conforming changes.
