SB1118 authorizes the director of the Arizona Department of Administration (ADOA) to enter into a lease-to-own agreement for the construction and ownership of a state archives building in the Capitol Mall area. A strike-everything amendment has been drafted for consideration.  The provisions follow.

 

Provisions

 

·                      Provides immunity from liability to persons or entities appointed by the court to assist with the disposition of an action, with exceptions related to misconduct with disposition to the case.

 

·                      Specifies that the prescribed acts of misconduct are not intimately related and essential to the judicial decision making process

 

·                      Requires acts of misconduct to be reported to the trial judge and the commission on judicial conduct, or to the appropriate board for further proceedings.

 

·                      Stipulates that reports, opinions or recommendations that result from misconduct shall be stricken and expunged from the record and shall not be considered by the court for any purpose.

 

·                      Allows court-appointed personnel to attempt to show that an exemption from personal liability is justified by overriding considerations of public policy.
