SB 1092 provides for the reappointment of the ombudsman-citizens aide.
The office of the ombudsman-citizens aide was established to service citizens’ complaints by investigating the administrative acts of state agencies and to annually report to the governor, the legislature and the public on its activities. This office is responsible for investigating acts that it has reason to believe may be:
1. Contrary to law.
2. Unreasonable, unfair, oppressive, arbitrary, capricious, an abuse of discretion or unnecessarily discriminatory, even though they may be in accordance with the law.
3. Based on a mistake of fact or improper or irrelevant grounds.
4. Unsupported by an adequate statement of reasons.
5. Performed in an inefficient or discourteous manner or otherwise erroneous.
· Reappoints Patrick M. Shannahan to the office of ombudsman-citizens aide for a term ending from and after June 30, 2006.
· Requires approval (pursuant to Section A.R.S. 41-1373, subsection B) of the appointment by roll call vote of at least two-thirds of each house of the legislature and the approval of the governor, or approval by roll call vote of at least three-fourths of each house of the legislature, if vetoed by the governor.
