SB 1064 transfers to the Department of Health Services the authority to create and enforce rules for residential treatment facilities.

 

History

In current statute, the Division of Behavioral Health Services within the Department of Health Services [DHS] is designated to set standards for and inspect residential treatment facilities.  In practice however, the Division of Assurance and Licensure Services actually inspects these facilities.  SB 1064 will place both duties back under the discretion of the director of DHS to insure consistency between statute and practice. 

 

Provisions

·                      Transfers the authority to create and enforce rules in both public and private residential treatment facilities to DHS, from the Division of Behavioral Health Services.

 

·                      Makes technical corrections.
