SB 1037 creates the motorcycle safety fund, and transfers one dollar of each motorcycle registration fee from the state highway fund to the motorcycle safety fund.

History

Laws 1996, Chapter 76 established the state motorcycle education fund to implement a motorcycle testing program and a voluntary motorcycle education program with one-dollar of each nine-dollar Arizona motorcycle registration fee.  Laws 1997, Chapter 1 eliminated the state motorcycle education fund and transferred the registration fee deposits to the state highway fund.

Provisions

·              Creates the motorcycle safety fund and diverts one dollar from each motorcycle registration from the state highway fund to the motorcycle safety fund through June 30, 2005.

·              Requires the director of the Arizona Department of Transportation to administer the fund.

·              Specifies that grants, donations or monies from gifts be deposited into the motorcycle safety fund.

·              Stipulates that monies from the Motorcycle Safety Fund shall be utilized to implement and support voluntary motorcycle education, awareness and other programs including covering the cost of material for motorcycle safety, education and awareness programs.

·              Exempts the motorcycle safety fund from lapsing of appropriations.

·              Requires monies deposited in the motorcycle safety fund, exceeding $150,000, to revert the state highway fund.

SB 1037 passed the Public Institutions & Rural Affairs Committee unamended.

SB 1037 was amended in the Appropriations Committee as follows:

·              Adds statutory language that clarifies monies in the fund are subject to legislative appropriation.

The Appropriations Committee amendment was adopted in the Committee of the Whole.
